By accessing and using the Hess Mechanical Construction Operations Portal ("Portal"), you agree to be bound by these Terms of Service ("Terms"). This Portal is provided exclusively for authorized employees and contractors of Hess Mechanical Construction for internal business operations.

• Current employees of Hess Mechanical Construction
• Authorized contractors with valid credentials
• Individuals explicitly granted access by company administration

Your login credentials are personal and non-transferable. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Data Ownership

All data entered into or generated by this Portal, including but not limited to field tickets, time entries, project information, and reports, is the sole property of Hess Mechanical Construction. You acknowledge that you have no ownership rights to any data within the Portal.

5. Account Responsibilities

You are responsible for:

• Keeping your password secure and changing it if you suspect compromise
• Logging out of the Portal when using shared or public devices
• Notifying administration immediately if you believe your account has been compromised
• Ensuring all information you submit is accurate and complete

6. Privacy and Data Handling

The Portal collects and stores data necessary for business operations, including user activity logs. This data is used for operational purposes, auditing, and system security. Your use of the Portal constitutes consent to this data collection and storage.

7. System Availability

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HESS MECHANICAL CONSTRUCTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE PORTAL.

10. Termination

Your access to the Portal may be terminated at any time, with or without cause, at the discretion of Hess Mechanical Construction. Upon termination of employment or authorization, your access will be revoked and you must immediately cease all use of the Portal.

11. Modifications to Terms

Hess Mechanical Construction reserves the right to modify these Terms at any time. Continued use of the Portal after changes constitutes acceptance of the modified Terms.
